The Council failed to reach agreement on the proposed Regulation creating a Community Patent despite the agreement on the broad outlines reached by the same Council in March 2003.
Several points were problematic, the most sensitive one being how to treat the infringements of patents which might arise as a result of mistranslations.
It is really disappointing, as the Commissioner Bolkenstein said, to see that more than two years after the deadline set by the Lisbon European Council, and a whole year after the Council agreed the main principles, the Council has not been able to find an agreement regarding this crucial question. It is indeed not anymore debatable that European industry desperately seeks for secure pan-European patent protection at reasonable cost.
